IWLA Comments on the STB’s Proposed Reciprocal Switching Regulations

IWLA submitted comments in support of the Surface Transportation Board’s (STB) proposed reciprocal switching regulations. The regulations would adjust the circumstances under which the STB may require the establishment of reciprocal switching, providing railroad customers with greater access to nearby rails in situations where switching is both feasible and necessary for competition.

In comment, IWLA argued that existing regulations impose too high of a regulatory burden for any rail customer to successfully request reciprocal switching, an argument reinforced by the STB’s own comments that current regulations have “effectively operated as a bar” rather than as “a standard under which [switching] could be granted.”

IWLA stated that the proposed reciprocal switching regulations, “would empower rail customers, including 3PL warehouses, to choose a carrier that provides the best combination of rates and service,” and that such choices, “will help achieve the Staggers Act’s vision of a healthy and competitive freight rail system.” To read the full comments, please click here.
