House Committee Approves Substantial Penalties for Labor Law Violations

As part of the larger reconciliation package, the House Education and Labor Committee advanced provisions from the PRO Act that include substantial penalties for violating the National Labor Relations Act.

The provisions give the National Labor Relations Board the authority to levy fines as high as $50,000 per labor violation and $100,000 for repeat offenders on top of damages paid to workers. The proposal allows for $100,000 fines if the violation resulted in an employee getting fired.

The committee’s proposal also seeks to overhaul the labor enforcement landscape, giving the U.S. Labor Department a much more muscular presence over the next five years. It provides funding to hire more lawyers to prosecute cases and more investigators to review businesses for wage, safety, and discrimination violations.
