David Weil Nomination Stalled

David Weil’s nomination to be administrator of the Department of Labor’s (DOL) Wage and Hour Division was stalled in a 11-11 vote by the Senate HELP Committee. During his time as administrator of the Wage and Hour Division under the Obama administration, Weil oversaw the adoption of a strict standard for “independent contractor” classification, a broadening definition for “joint employer” or those considered liable as joint employers under the Fair Labor Standards Act, and an unlawful revision of a white collar overtime rule that was found by a federal court to exceed DOL’s rule-making authority.

In a letter to the HELP Committee and Senate leadership, IWLA called for the rejection of Weil’s nomination citing his track record of bias against employers and concern that his policies would harm workers and small businesses. Weil’s nomination will need an additional vote from the full Senate in order to be discharged from the committee and approved.
