OSHA Publishes Update to Powered Truck Rule

The Occupational Safety and Health Administration (OSHA) published a Notice of Proposed Rulemaking to update the design and construction requirements for the agency’s powered industrial truck standards for general industry and construction, 29 CFR 1910.178. The rulemaking will affect fork trucks, tractors, platform lift trucks, motorized hand trucks, and other specialized industrial trucks powered by an electric motor or internal combustion engine.

OSHA is updating the standards by adding references to the latest design and construction requirements published by the American National Standards Institute and the Industrial Truck Standards Development Foundation. The proposed rule will also allow employers to use powered industrial trucks whose construction is not built in accordance with OSHA’s national consensus standards if the employer can demonstrate that the truck was designed and built in a manner that provides employee protection that is at least as effective as OSHA’s national consensus standards. 

The rulemaking is a part of a series of regulatory projects by OSHA to update outdated industrial standards. Comments on the proposed rule are due by May 17, 2022.
