DOL Deputy Secretary Confirmed; David Weil Hearings Progress
Julie Su was confirmed in a 50-47 party line vote as the new Deputy Secretary for the Department of Labor (DOL) last week. Su previously served as the head of California’s Labor and Workforce Development Agency where she implemented and enforced California’s employment policies. She is known for being an ardent supporter and enforcer of worker’s rights. Progressives hope Su will play an outsize role as second in command at the DOL, while some business groups expressed concern that Su could move the department in a more liberal direction.
Last week the Senate HELP Committee also held a hearing on the nomination of David Weil to serve as Administrator for the DOL’s Wage and Hour Division, a post he previously held under the Obama Administration from 2014 to 2017. IWLA, along with 13 other prominent business groups, urged the Committee and Senate leadership to reject Weil’s nomination citing his track record of bias against employers and their concern that his policies would harm workers and small businesses. Weil oversaw the adoption of a strict standard for “independent contractor” classification, a broadening of the definition for “joint employer” or those considered liable as joint employers under the Fair Labor Standards Act, and an unlawful revision of a white collar overtime rule that was found by a federal court to exceed DOL’s rule-making authority
