IWLA Webinar: Level Up to the New Salary Level Part 2 – Deep Dive on Job Duties

The DOL’s publication of its proposed changes to the FLSA’s “white collar” exemptions may require employers to reconsider the exempt status of employees currently classified as exempt and paid a minimum guaranteed salary of less than $1,059 per week (assuming state law does not already require a higher minimum salary for exempt employees). In the course of evaluating these positions for potential reclassification due to salary level, employers may wish to take the opportunity to address any concerns they have about whether certain positions meet the “job duties” tests of the applicable exemptions. Where it is advisable to reclassify a position based on job duties, there is value to doing it in the context of other changes stemming from the salary level increase.

This webinar will provide employers with a deep dive on the duties tests for each of the “white collar” exemptions. It will include guidance for employers on the process for assessing whether their exempt employees still meet the applicable job duties criteria and how to proceed if the conclusion is that they may not.
