Senate Democrats Introduce Anti-Union Tax Bill

Senators Bob Casey (D-PA), Ron Wyden (D-OR), Patty Murray (D-WA), Cory Booker (D-NJ) and Chris Van Hollen (D-MD) recently introduced S.4192, the No Tax Breaks for Union Busting Act, legislation that would alter the tax code to prohibit companies from writing off “anti-union” activities as business expenses. The bill has 20 Democratic cosponsors and no Republican cosponsors.

S.4192 would ban deductions of both legal and illegal anti-union activities. Illegal activities include violations of the National Labor Relations Act, while legal efforts include “captive audience meetings” and anti-union advertising campaigns. The bill is designed to discourage employers from speaking to employees about the pros and cons of unionization. The legislation would also establish an IRS reporting requirement for employers who intervene in protected labor activities.
