FMCSA Publishes NOI for CMV Speed Limiting Rule

The Federal Motor Carrier Safety Administration (FMCSA) published a notice of intent (NOI) to proceed with a speed limiter rulemaking for motor carriers operating commercial motor vehicles (CMVs) in interstate commerce with a gross vehicle weight exceeding 26,000 pounds. The rule would require the trucks to be equipped with an electronic engine control unit (ECU) capable of governing the maximum speed to a limit determined by the rulemaking and to maintain the unit setting for the service life of the vehicle. FMCSA anticipates publishing the rulemaking in 2023 and will use information obtained through comments on the NOI to inform the proposed rulemaking.

FMCSA is pursuing the carrier-based rulemaking following data from the National Roadway Safety Strategy that identified speed as a significant factor in fatal crashes and speed management as a primary tool to reduce serious injuries and fatalities. FMCSA believes a carrier-based approach would compel fleets that don’t use speed limiters to slow down their CMVs.
