SUMMARY:IWLA Webinar: Level Up to the New Salary Level Part 1 - Employer Roadmap to the DOL's Proposed Overtime Rule
DESCRIPTION:The DOL has unveiled its long-awaited proposed rule to again increase the minimum guaranteed weekly salary for the FLSA’s “white collar” exemptions\, this time from $684 to $1\,059 per week (or more depending on when the rule is finalized). If adopted\, the proposed increase will require employers that are not already required to pay exempt employees a higher minimum salary under state law to reevaluate the classification status of exempt employees currently paid a salary below $1\,059 per week (and potentially those paid more.) \nThis webinar will provide a roadmap for employers on developing a strategy to respond to the proposed salary level increase and to the other changes in the DOL’s proposed rule. It will include a discussion of important considerations related to reclassifying employees affected by the proposed increase. It will also provide a refresher on the salary basis test. In particular\, we will discuss the impact of the recent Supreme Court decision that resulted in an employer owing an already high-earning employee overtime pay because\, according to the Court\, the employer’s compensation scheme did not meet the DOL’s technical rules for paying exempt employees on a salary basis.

DESCRIPTION:The DOL’s publication of its proposed changes to the FLSA’s “white collar” exemptions may require employers to reconsider the exempt status of employees currently classified as exempt and paid a minimum guaranteed salary of less than $1\,059 per week (assuming state law does not already require a higher minimum salary for exempt employees). In the course of evaluating these positions for potential reclassification due to salary level\, employers may wish to take the opportunity to address any concerns they have about whether certain positions meet the “job duties” tests of the applicable exemptions. Where it is advisable to reclassify a position based on job duties\, there is value to doing it in the context of other changes stemming from the salary level increase. \nThis webinar will provide employers with a deep dive on the duties tests for each of the “white collar” exemptions. It will include guidance for employers on the process for assessing whether their exempt employees still meet the applicable job duties criteria and how to proceed if the conclusion is that they may not.
