SUMMARY:IWLA Webinar: Level Up to the New Salary Level Part 1 - Employer Roadmap to the DOL's Proposed Overtime Rule
DESCRIPTION:The DOL has unveiled its long-awaited proposed rule to again increase the minimum guaranteed weekly salary for the FLSA’s “white collar” exemptions\, this time from $684 to $1\,059 per week (or more depending on when the rule is finalized). If adopted\, the proposed increase will require employers that are not already required to pay exempt employees a higher minimum salary under state law to reevaluate the classification status of exempt employees currently paid a salary below $1\,059 per week (and potentially those paid more.) \nThis webinar will provide a roadmap for employers on developing a strategy to respond to the proposed salary level increase and to the other changes in the DOL’s proposed rule. It will include a discussion of important considerations related to reclassifying employees affected by the proposed increase. It will also provide a refresher on the salary basis test. In particular\, we will discuss the impact of the recent Supreme Court decision that resulted in an employer owing an already high-earning employee overtime pay because\, according to the Court\, the employer’s compensation scheme did not meet the DOL’s technical rules for paying exempt employees on a salary basis.

DESCRIPTION:The DOL’s publication of its proposed changes to the FLSA’s “white collar” exemptions may require employers to reconsider the exempt status of employees currently classified as exempt and paid a minimum guaranteed salary of less than $1\,059 per week (assuming state law does not already require a higher minimum salary for exempt employees). In the course of evaluating these positions for potential reclassification due to salary level\, employers may wish to take the opportunity to address any concerns they have about whether certain positions meet the “job duties” tests of the applicable exemptions. Where it is advisable to reclassify a position based on job duties\, there is value to doing it in the context of other changes stemming from the salary level increase. \nThis webinar will provide employers with a deep dive on the duties tests for each of the “white collar” exemptions. It will include guidance for employers on the process for assessing whether their exempt employees still meet the applicable job duties criteria and how to proceed if the conclusion is that they may not.

And what are the trends that need to be tracked to remain competitive in a rapidly changing trading environment? \n\nDr. Thomas O’Brien is the executive director of the Center for International Trade and Transportation (CITT) at California State University\, Long Beach (CSULB) and the Associate Director of Long Beach Programs for the METRANS Transportation Center\, a partnership of CSULB and the University of Southern California. He also serves as the Director of the FHWA Southwest Transportation Workforce Center (SWTWC).  He previously served as CITT’s Director of Research. Dr. O’Brien is an instructor in CSULB’s Master of Science in Supply Chain Management (MSSCM)\, Global Logistics Specialist (GLS) Professional Designation and Marine Terminal Operations Professional (MTOP) programs. \nDr. O’Brien is a member of the Executive Committee of the Council of University Transportation Centers (CUTC) where he serves as Treasurer and is a member of the CUTC Workforce Development Taskforce and Chair of the oversight committee of the National Science Foundation’s National Center for Supply Chain Technology Education. He is a member of the Transportation Research Board’s Intermodal Freight Transport Committee and Intermodal Freight Terminal Design and Operations Committee.  He also serves on the Boards of the Southern California Roundtable of the Council of Supply Chain Management Professionals\, Los Angeles Transportation Club\, Foreign Trade Association\, and National Transit Institute. Dr. O’Brien has a Master’s degree in Urban Planning and Development and a Ph.D. in Policy\, Planning\, and Development from the University of Southern California. He is both an Eno and Eisenhower Transportation Fellow.

DESCRIPTION:IWLA is pleased to announce that we will be holding our annual Legislative Fly-In Days in person again this year. The event will take place on Tuesday\, May 7 and Wednesday\, May 8 in Washington D.C. We invite you to come join us as we advocate on behalf of the 3PL industry and help educate legislators on the critical role that warehousing plays in the supply chain\, and the issues that are important to our industry. \nThis is a great opportunity to connect with your legislators and develop useful connections with your Members of Congress\, and become a trusted resource for them when issues affecting the warehousing industry are introduced in Congress. There will also be opportunities to hear from our distinguished speakers\, which will include Members of Congress\, Public Policy Experts\, and Stakeholders from the Supply Chain and Warehousing industry. Additionally\, you will have the chance to educate yourself on some of the legislative issues that impact our industry\, network with other IWLA members\, advocate on behalf of the warehousing industry\, and support our 3PL community’s legislative and regulatory goals. \nThis premier event will be held Tuesday\, May 7 and Wednesday\, May 8\, at the Grand Hyatt Washington\, D.C.\, with visits to Capitol Hill scheduled for the afternoon of Wednesday\, May 8\, 2024. The IWLA Member registration fee is $349.
